WORKPLACE INJURIES When you are injured at work by the negligence of your employer or a fellow employee, you normally cannot sue them. Instead, you are entitled to apply for Workers Compensation benefits for your injuries, regardless of whether you were at fault or someone else was at fault for your injuries. HOWEVER, if you are injured at work by the negligence of a third party, other than your employer or a fellow employee, you may be able to bring a lawsuit against the third party. For Example: If you are injured at work because of a defect in a machine that you use to do your job, you may be able to bring a lawsuit against the manufacturer of the machine. Or, suppose you work at the local grocery store, are collecting carts from the parking lot, and a customer negligently runs into you with their car. You may be able to bring a claim or lawsuit against the driver of that car.
